Terms of Service

These terms are an agreement between you and Blue Aurora Ventures LLC, a [STATE] limited liability company (“we”, “us”, “our”). They cover your use of Wantasaur: the website, the web app, and our iPhone, iPad and Android apps (together, “Wantasaur”).

By using Wantasaur, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Wantasaur.

1. Who can use Wantasaur

• Grown-ups: you must be 18 or older to create an account, subscribe, or use the grown-up area.
• Children: children may use kid mode only with the permission and supervision of a parent or legal guardian. Children can’t create accounts.
• Responsibility: if you let a child use Wantasaur, you accept these terms for them and are responsible for their use. Please keep your grown-up passcode to yourself. The passcode and the parental gate help, but no lock is perfect.

2. What Wantasaur is

Wantasaur helps children build wishlists for occasions such as a birthday or Christmas inside budgets that a parent sets, and lets them earn extra budget by solving math, spelling and word puzzles. Grown-ups create the budgets and their dates, choose how much the puzzles can earn each day, move unused budget into a year budget or lifetime savings, review and approve the list, search stores, and share the list. Store gift search for children is off until a grown-up turns it on.

• The budget isn’t money. Budgets, rewards and earnings are numbers inside the app. They aren’t real money, a stored balance, gift card or prize. They have no cash value, can’t be withdrawn or exchanged, and we don’t pay anything to anyone because of them. Whether and how a family honors a wishlist is entirely up to that family.
• Learning content is for practice. Our math, spelling and word puzzles are for fun practice. We work to keep them accurate, but they aren’t a substitute for schoolwork or teaching.
• Prices and items are estimates. Sample items, prices and store details in the app may be incomplete, out of date or wrong. Always check the store before you buy.

3. Accounts and families

• You can use Wantasaur without an account. Then your list stays on your device (see the Privacy Policy for the few things that are sent, such as store searches if you turn them on). If you lose or reset the device, or clear your browser data, it may be gone for good.
• A parent account is optional. You sign in with a one-time code sent to your email. Keep your email account secure. Anyone who can read your email can sign in to Wantasaur.
• When you create an account, you confirm that you are 18 or older and the parent or legal guardian of the child, and that you consent to how we handle your child’s information as described in our Privacy Policy.
• A second parent or guardian can join your family with a family invite code. Everyone in a family can see and change the family’s list and settings. Only share the code with someone you trust. When the last grown-up in a family deletes their account, the family’s data is deleted.
• Please give accurate information, and use a nickname for your child, not their full name.
• You can delete your account at any time in Grown-ups → Privacy and your data → Delete my account, or by emailing us.

4. Wantasaur Plus subscriptions

Free and Plus

Free includes the wishlist, budgets, toy shop, store search, sharing, trophies and 5 math or spelling questions a day. Wantasaur Plus adds unlimited questions, the daily secret-word puzzle, and future premium features. We may change what each plan includes over time. If a change takes away something important you have paid for, you can cancel and ask us for a refund of the unused part of a web subscription.

Price and renewal

• Plus costs US$7.99 per year. Where we offer a monthly plan, it costs US$1 per month on the web or US$0.99 per month in the App Store and Google Play. In other countries the store shows the local price. The exact price, including any tax, is shown before you pay.
• Plus renews automatically at the end of each period, and the same price is charged to your payment method for the next period, until you cancel. There is no minimum term: you can cancel at any time.
• On the web, before checkout you tick a box agreeing to automatic renewal, and we keep a record of it. We (through Stripe) email you a reminder between 15 and 45 days before each yearly renewal, with the price, the date and how to cancel.
• Plus is linked to your family account and works on your family’s signed-in devices.
• If we change the price, we will email you between 7 and 30 days before the change takes effect (and in any case before your next renewal at the new price). You can cancel before then.

Free trials

New families can try Wantasaur Plus free for 7 days (one trial per family on the web, and one per Apple or Google account in the stores). You give your payment details when the trial starts. If you don’t cancel before the trial ends (on the App Store and Google Play, at least 24 hours before), your paid subscription starts automatically and you are charged for the first period. From then on the normal subscription and refund terms apply. We show the trial length, the date it ends and the price before you start, and the grown-up area shows when your trial ends.

Where you subscribe, and how to cancel

• iPhone or iPad: billed by Apple to your Apple Account (Apple ID). Manage or cancel in your Apple Account subscription settings (Settings → your name → Subscriptions). Cancel at least 24 hours before the renewal date to avoid being charged for the next period.
• Android: billed by Google Play. Manage or cancel in Google Play (Profile → Payments & subscriptions → Subscriptions).
• Web: billed by Stripe. Cancel online at any time: Grown-ups → Plus → Manage subscription → Cancel. You can also email us and we will cancel it for you.

When you cancel, Plus stays on until the end of the period you have paid for, then your family moves back to the free plan. Your list isn’t deleted.

Deleting your account doesn’t cancel an Apple or Google subscription. We can’t cancel those for you. Please cancel them in your Apple Account or Google Play settings. If you subscribe in more than one place, you will be billed in each place, so cancel the one you don’t need.

Refunds

• Apple and Google: refunds are handled by Apple or Google under their own policies. We can’t issue them.
• Web refunds, 7 days (14 days in the UK and EU): if you aren’t happy, email [email protected] within 7 days of any web payment (your first payment after a trial, or a renewal) and we will refund that payment in full and end Plus. If your billing address is in the UK, the EU or the EEA, you have 14 days instead. Where you live is taken from the billing address you gave at checkout. After that, we don’t give refunds or credits for part of a billing period or unused time, except where the law requires it or as described in these terms. When you cancel, Plus stays on until the end of the period you paid for and then stops.

Right of withdrawal (UK, EU and other countries with a cooling-off right)

If you are a consumer in the UK, the EU or another country that gives a cooling-off right, you can withdraw from a web subscription within 14 days of the day you subscribed (the day your trial or paid subscription started) without giving a reason. Our UK and EU refund above goes further than this: you can also get a full refund within 14 days of each later payment. We will refund you in full, using the same payment method, within 14 days of hearing from you, and we won’t deduct anything for the time you used.

To withdraw, tell us clearly, for example by email to [email protected]. You may use this model form, but you don’t have to:

Subscriptions bought through the App Store or Google Play are covered by Apple’s or Google’s cancellation and refund rules instead.

5. Store links and affiliate links

• We don’t sell products. In the grown-up area, Wantasaur can search real stores (such as Amazon, Walmart, Target and Argos) and open links to them. These links are only in the grown-up area, behind a parental gate.
• When you follow a link, you leave Wantasaur. Anything you buy is between you and that store. Their terms, prices, delivery and return policies apply, and we aren’t responsible for their products, sites or services.
• Store names and logos belong to their owners. Showing them doesn’t mean a store endorses Wantasaur.
• Affiliate disclosure: some store links are affiliate links. If you buy something after tapping one, we may earn a commission. This doesn’t change the price you pay. As an Amazon Associate we earn from qualifying purchases.

6. Using Wantasaur responsibly

Please don’t:

• break the law, or use Wantasaur to harm, harass or deceive anyone
• enter other people’s personal information without permission, or put your child’s full name, address, school or contact details in free-text fields
• try to get into another family’s data, our systems, or anything you aren’t allowed to access
• interfere with, overload or attack Wantasaur, or get around its limits or the parental gate on purpose for a child
• copy, scrape, resell or reverse-engineer Wantasaur, except where the law allows it
• use Wantasaur for commercial purposes, or for anything other than personal and family use

We may suspend or close an account that breaks these rules. Where it’s fair to do so, we will tell you first.

7. Your content

What you and your family add to Wantasaur, such as wishes, wish requests and family picks, belongs to you. If you sign in, you give us permission to store, copy and display it only as needed to run Wantasaur for your family. That permission ends when you delete the content or your account, subject to our backup schedule in the Privacy Policy.

8. Our content

Wantasaur, including its design, code, sample items, puzzles, word lists and artwork, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use Wantasaur for your family under these terms. You may use the share or copy feature to share your family’s list. If you send us feedback or ideas, we may use them without owing you anything.

9. Apple and Google terms

If you got Wantasaur from the Apple App Store or Google Play, their terms also apply to you. If you use Wantasaur on an Apple device:

• These terms are between you and us, not Apple. We, not Apple, are responsible for Wantasaur and its content.
• Your license is to use Wantasaur on Apple-branded devices you own or control, as allowed by Apple’s Usage Rules.
• Apple has no duty to provide maintenance or support for Wantasaur.
• If Wantasaur fails to meet a warranty that applies to it, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty duty for Wantasaur.
• We, not Apple, are responsible for handling any claims about Wantasaur, including product liability claims, claims that it fails to meet legal requirements, and consumer protection or privacy claims.
• We, not Apple, are responsible for investigating and handling any claim that Wantasaur infringes someone else’s intellectual property.
• You confirm you are not in a country subject to a US government embargo, and are not on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Changes to Wantasaur and ending these terms

• We are always improving Wantasaur, so features may change, be added or be removed.
• You can stop using Wantasaur at any time and delete your account.
• We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to for legal reasons.
• If we ever shut Wantasaur down, we will give you at least 30 days’ notice and time to copy your list, stop all future renewals, and refund the unused part of any web subscription. Refunds for app store subscriptions go through Apple or Google.

11. Disclaimers

We work hard to make Wantasaur reliable and safe, but it is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that Wantasaur will always be available or error-free, or that store prices, availability or product information will be accurate.

12. Limits on liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of Wantasaur or of any store you reach through it. Our total liability for any claim about Wantasaur is limited to the greater of the amount you paid us for Wantasaur in the 12 months before the claim, or US$50.

Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you are a consumer in the UK or EU, you also keep all your statutory rights. Nothing in these terms takes them away.

13. Governing law and disputes

If you have a problem, please email us first at [email protected]. Most issues can be sorted out quickly.

These terms are governed by the laws of the State of [STATE], USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [STATE], and you and we agree to their jurisdiction. If you are a consumer living in the UK or EU, you can also bring a claim in the courts where you live, and the mandatory consumer laws of your country still apply.

14. Changes to these terms

We may update these terms. We will change the effective date at the top. If a change is important, we will tell account holders by email or in the app before it takes effect. If you keep using Wantasaur after a change takes effect, you accept the new terms. If you don’t agree, you can stop using Wantasaur and delete your account.

Other legal bits

• These terms and our Privacy Policy are the whole agreement between you and us about Wantasaur.
• If part of these terms can’t be enforced, the rest still applies.
• If we don’t enforce a term right away, we can still enforce it later.
• You can’t transfer these terms to someone else. We may transfer them if our business changes hands.
